SAN JOSE EARTHQUAKES SOCCER MOM OF THE MATCH PRESENTED BY WELLS FARGO CONTEST OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN.  A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

ELIGIBILITY: SAN JOSE EARTHQUAKES SOCCER MOM OF THE MATCH PRESENTED BY WELLS FARGO CONTEST is sponsored by Earthquakes Soccer L.L.C., Major League Soccer, L.L.C., Soccer United Marketing, LLC, and Wells Fargo Bank, N.A. The contest is open to legal residents of the state of California, who are of legal age of majority in the jurisdiction in which they reside and at least 18 years old at the time of entry.  Employees, officers, and directors (including immediate family members (spouse, parent, child and sibling and their respective spouses, regardless of where they reside) and members of the same household, whether or not related) of, the Sponsors, and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers and advertising and promotion agencies, and any and all other companies associated with the Contest are not eligible to participate or win a prize.  The Contest is subject to all applicable federal, state, and local laws, rules and regulations.  Void where prohibited or restricted by law, rule or regulation.

WHEN TO ENTER:  The Contest begins February 28, 2012 at 11:59:59 a.m. Pacific Time (PT) and ends at 11:59:59 p.m. Pacific Time (PT) on October 15, 2012. Anybody may enter the Contest at any time between February 28, 2012 at 11:59:59 a.m. Pacific Time (PT) and October 15 at 11:59:59 p.m. Pacific Time (PT) and is comprised of seventeen (17) registration periods as indicated below.  Limit one nomination per “Soccer Mom.”  “Soccer Mom” entries will automatically roll over into the following Registration Period if not Selected as a winner during the Registration Period initially enrolled. For clarity, if a Soccer Mom is registered during Registration Period 3 and is not Selected, such Soccer Mom will still be eligible to be Selected for Registration Periods 4, 5, 6,7, 8, 9, 10, 11, 12, 13, 14, 15, 16 and 17.  In the event that an entry is selected as a winner in a given Selection that entry will no longer be eligible to win additional prizes. The Promotion consists of seventeen (17) individual prizes Contest.  Each Contest will have its own Selection Date (see chart in below for each Contest’ Registration Period and corresponding Selection Date).

HOW TO ENTER: No purchase necessary to enter or win.  Making a purchase will not improve your chances of winning.  There are two (2) ways to enter, in person or online. No other methods of entry will be accepted.  Each method of entry requires entrant to submit a 250 word essay on why the Soccer Mom deserves to be the Soccer Mom of the match.  Limit one (1) entry per person, per e-mail address and per household, regardless of method of entry. Multiple entries received from any person or e-mail address or household in excess of the stated limitation will be void. Nominations may include both males and females.

1. In-Person Method: During the Promotion Period visit the San Jose Earthquakes Front Office at 451 El Camino Real, Suite 220, Santa Clara, Calif. 95050.  An Earthquakes Representative will provide the eligible customer with a registration form to fill out in its entirety and return to the representative. Must also provide a 250-word essay about why The Soccer Mom deserves to be the Soccer Mom of the Match. 

2. Online Method: If you do not wish to enter the Contest in person, you may enter by submitting a nomination form at www.sjearthquakes.com/soccermom which includes a 250-word essay about why The Soccer Mom deserves to be the Soccer Mom of the Match.  Once both pieces are completed the Soccer Mom will be entered in the contest and eligible for each Selection process.

SELECTION DEADLINES:  There will be a total of seventeen (17) selections from February 28, 2012 through October 19, 2012 from among all eligible entries received by the applicable selection entry deadline. Selections will occur on applicable Selection Dates listed above at or approximately 10:00 a.m. Pacific Time (PT). All non-winning eligible entries from one selection will be eligible for all subsequent selections. 

No mechanically reproduced, illegible, forged, software generated, other automated or incomplete entries will be accepted.  Contest entries will be deemed null and void and will be rejected if not submitted through authorized, legitimate channels.  If a dispute as to the identity of any entrant cannot be resolved to Sponsors’ satisfaction, the entry will be deemed ineligible.  Entry must be made by the entrant, only in the manner as set forth herein.  All other methods of entry are considered void.   

All entries become the exclusive property of Sponsors and will not be acknowledged or returned.  As permitted by law, each entrant agrees that personal information collected in connection with the Contest may be shared with the Sponsors to contact you regarding promotional update; information; messages; and for other reasons via electronic and/or ordinary mail and, will be used by Sponsors and such promotional partners in compliance with their respective privacy practices.  

SELECTION: There will be seventeen (17) potential winners of the Contest selected by a panel of three Earthquakes Representatives (the “Judges”) on or about each Selection Date from all eligible entries received by the applicable selection entry deadline by the Sponsor (see above for corresponding Selection Dates).  The Judges will judge all submissions based on the following items (the “Judging Criteria”): (i) overall commitment of the Soccer Mom to her soccer teams she supports (50%); (ii) the Soccer Mom’s passion for Soccer (25%), and (iii) creativity in presentation of the submission (25%).  In the event of a tie for any prize, the overall commitment score will be used as the tiebreaker.  Sponsor reserve the right to not award any prize or all prizes if, in its sole discretion, it does not receive a sufficient number of eligible or qualified entries during the Contest Period.  The decisions of Sponsor, including the selection of Winners, are final and binding on all matters relating to this Contest. Odds of winning depend on the total number of eligible entries received for the applicable selection. Limit one (1) prize per person, family and per household.

PRIZES: Seventeen (17) Prizes Are Available To Be Awarded.  Each Winner will receive one (1) prize package which includes four tickets to one 2012 San Jose Earthquakes home match, one parking pass to a 2012 San Jose Earthquakes home match, a “Soccer Mom of the Match” jersey, pre-game recognition on the field, pre-game recognition on the San Jose Earthquakes video board and entrance onto the field at Buck Shaw Stadium to watch pre-game warm ups by the San Jose Earthquakes. Approximate Retail Value (“ARV) of each Prize Package:   .  ARV of all Prizes: $4,050.  Each Winner is fully responsible for any and all applicable federal, state, and local taxes (including income and withholding taxes).  All costs and expenses associated with Prize acceptance and use not specified herein as being provided, and other expenses incurred by accepting the Prize are the sole responsibility of each Winner. All Prize details are at Sponsor’s sole discretion. 

The Prize is non-transferable and non-assignable, with no cash redemptions or substitutions except at the Sponsor’s sole and absolute discretion.  The Sponsor reserves the right to substitute a prize (or portion thereof) with one of comparable or greater value, at its sole and absolute discretion. Major League Soccer game, event, and exhibition dates and times are determined in the sole discretion of Major League Soccer and/or the applicable Major League Soccer team, as applicable, and may be subject to change. Seat locations will be determined by Sponsors.

NOTIFICATION:  The potential Winner will be notified by e-mail, mail and/or telephone (in the sole discretion of the Sponsors, as applicable) by the Sponsors or Sponsors’ agent in their sole and absolute discretion and such determination will be final and binding.  In the event that any potential Winner does not respond to any such notification within two (2) days of date of issuance, a disqualification will result, prize will be forfeited and, at Sponsors’ sole discretion and time permitting, an alternate potential Winner may be chosen from among all remaining eligible entries.  The potential Winner may be required to submit his/her valid social security number (if applicable) and/or other identification to Sponsors and will be required to execute, have notarized and return an Affidavit of Eligibility and Release of Liability and, unless prohibited by law, Release of Publicity, within five (5) days of date of issuance.  If all required documents are not properly executed and returned within the specified period of time, a disqualification will result, prize will be forfeited and, at Sponsors’ sole discretion and time permitting, an alternate potential Winner may be randomly selected from among all remaining eligible entries.  Refusal or return of such documents as non-deliverable or potential Winner’s noncompliance with these Official Rules will also result in disqualification and prize forfeiture and, at Sponsors’ sole discretion and time permitting, may cause an alternate potential Winner to be selected from among all remaining eligible entries.

WAIVER OF LIABILITY/PUBLICITY RELEASE:  By participating in the Contest and submitting an entry, each entrant agrees to (i) be bound by these Official Rules, including all entry requirements, and (ii) waive any and all claims against Sponsors and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers, representatives and advertising and promotion agencies, and any and all other companies associated with the Contest, and all of their respective officers, directors, employees, agents and representatives for any injury, damage or loss that may occur, directly or indirectly, in whole or in part, from the participation in the Contest or from the receipt or use of any Prize or any travel or activity related to the receipt or use of any Prize. Winner, by acceptance of Prize, grants the Sponsors and each of their respective designees the right to publicize such Winner’s name, address, city and state, or district, of residence, photograph, voice and/or other likeness and prize information in any and all media now known or hereafter devised, throughout the world, in perpetuity, without additional compensation or consideration, notification or permission, unless prohibited by law.

GENERAL CONDITIONS:  Released Parties are not responsible for stolen, late, incomplete, illegible, misdirected, lost, damaged, garbled, delayed, undelivered, inaccurate, postage-due or garbled entries, e-mail or mail.  Entries generated by a script, macro or other mechanical or automated means or by any means which subvert the entry process will be disqualified.  Released Parties are not responsible for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing of entries, the announcement of the Prize or in any Contest-related materials, or the cancellation or postponement of any Major League Soccer game, event or exhibition.  Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Released Parties are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Contest or downloading materials from or use of the website. 

Persons who tamper with or abuse any aspect of the Contest or website or attempt to undermine the legitimate operation of the Contest by cheating, deception or other unfair playing practices, or intend to annoy, abuse, threaten or harass any other entrant or Sponsors representatives or who are in violation of these Official Rules, as solely determined by Sponsors, will be disqualified and all associated entries will be void.  Any attempt to deliberately damage the content or operation of this Contest is unlawful and subject to legal action by Sponsors and/or their respective agents.  Sponsors have the sole right to disqualify any entrant for violation of these Official Rules or any applicable laws relating to the Contest, and to resolve all disputes in their sole discretion.  Released Parties (i) make no warranty, guaranty or representation of any kind concerning any Prize, and (ii) disclaim any implied warranty.  All disputes will be resolved under applicable U.S. laws in the County of New York, state of New York without giving effect to choice of law or conflicted law principles (whether of the state of New York, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of New York.  Sponsors failure to enforce any terms of these Official Rules shall not constitute a waiver of that provision.

Sponsors, reserve the right, in their sole discretion, to cancel or suspend the Contest for any reason, including should virus, bugs, unauthorized human intervention, or other causes corrupt the administration, security, fairness, integrity or proper operation of the Contest.  In the event of cancellation, Sponsors may elect to identify the Winner and award the Prize by way of random selection from among all non-suspect, eligible entries received up to the time of such cancellation.

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS WILL DISQUALIFY ANY SUCH ENTRANT AND SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.

All entries must include a valid e-mail address for the entrant. Proof of providing the required information will not be considered proof of delivery to or receipt by Sponsors of entry into the Contest. In case of multiple entries received from any person or e-mail address or household, only the first entry received from such person, e-mail address or household will be considered. In the event of a dispute as to the identity or eligibility of a Winner based on an e-mail address, the winning entry will be declared made by the “Authorized Account Holder” of the e-mail address submitted at the time of entry provided he/she is eligible according to these Official Rules. The “Authorized Account Holder” is defined as the natural person to whom the applicable Internet service provider or other organization (such as a business or educational institution) has assigned the e-mail address for the domain associated with the submitted e-mail address. The potential winner may be required to provide Sponsors with proof that he/she is the authorized account holder of the e-mail address associated with the winning entry. The Sponsors reserves the right to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Contest.

WINNERS’ LIST:  For the Winner’s names (available after October 17, 2012 mail a self-addressed stamped envelope to: San Jose Earthquakes SOCCER MOM OF THE MATCH PRESENTED BY WELLS FARGO; 451 El Camino Real, Suite 220, San Jose, CA 95050.  Winner’s list requests must be received by October 30, 2012.
