GOALS FOR EDUCATION PRESENTED BY WELLS FARGO DONATION REQUEST FORM
NO PURCHASE NECESSARY TO COMPLETE DONATION REQUEST FORM OR BE SELECTED. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF SELECTION.
ELIGIBILITY: GOALS FOR EDUCATION PRESENTED BY WELLS FARGO DONATION REQUEST FORM is sponsored by Earthquakes Soccer L.L.C., Major League Soccer, L.L.C., Soccer United Marketing, LLC, and Wells Fargo Bank, N.A. The Donation Request Form is open to youth soccer programs or elementary, middle or high school athletic departments. Employees, officers, and directors (including immediate family members (spouse, parent, child and sibling and their respective spouses, regardless of where they reside) and members of the same household, whether or not related) of, the Sponsors, and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers and advertising and promotion agencies, and any and all other companies associated with the Donation Request Form are not eligible to participate or be Selected for a Donation. The Donation Request Form is subject to all applicable federal, state, and local laws, rules and regulations. Void where prohibited or restricted by law, rule or regulation.
WHEN TO ENTER: The Donation Request Form will accept submissions beginning on September 1, 2014 at 9:00:00 a.m. Pacific Time (PT) and ending at 9:00:00 a.m. Pacific Time (PT) on October 20, 2014. Anybody may make a Donation Request at any time between September 1 at 9:00:00 a.m. Pacific Time (PT) and October 20, at 9:00:00 a.m. Pacific Time (PT). Limit one request per person.
HOW TO ENTER: No purchase necessary to complete Donation Request Form or be Selected. Making a purchase will not improve your chances of Selection. There are two (2) ways to submit a Donation Request, in person or online. No other methods of Donation Request will be accepted. Each method of Donation Request requires the youth sports program or elementary, middle or high school athletic department to submit a 250 word essay on why submitting organization deserves to receive a Donation from the Goals for Education Presented By Wells Fargo program. Limit one (1) Donation Request per person and per e-mail address, regardless of method of Donation Request. Multiple Donation Requests received from any person or e-mail address in excess of the stated limitation will be void.
1. In-Person Method: During the Donation Request Period visit the San Jose Earthquakes Front Office at 451 El Camino Real, Suite 220, Santa Clara, Calif. 95050. An Earthquakes Representative will provide the person(s) representing the youth soccer program or elementary, middle or high school athletic department with a registration form to fill out in its entirety and return to the Earthquakes Representative. Must also provide a 250-word essay about why youth soccer program or elementary, middle or high school athletic department deserves to receive a Donation.
2. Online Method: If you do not wish to complete the Donation Request Form in person, you may enter by submitting a form at www.sjearthquakes.com/goalsforeducation which includes a 250-word essay about why the youth soccer program or elementary, middle or high school athletic department deserves to receive a Donation.
SELECTION DEADLINES: There will be a total of one (1) Selection Date following the conclusion of the Donation Request Period on October 20, 2014. Selections will occur on applicable Selection Date listed below at or approximately 9:00 a.m. Pacific Time (PT). All non-selected eligible Donation Requests from one Selection will be eligible for all subsequent Selections.
No mechanically reproduced, illegible, forged, software generated, other automated or incomplete Donation Requests will be accepted. Donation Requests will be deemed null and void and will be rejected if not submitted through authorized, legitimate channels. If a dispute as to the identity of any submission cannot be resolved to Sponsors’ satisfaction, the Donation Request will be deemed ineligible. Donation Request must be made by the entrant, only in the manner as set forth herein. All other methods of Donation Request are considered void.
All Donation Requests become the exclusive property of Sponsors and will not be acknowledged or returned. As permitted by law, each submitting organization agrees that personal information collected in connection with the Donation Requests may be shared with the Sponsors to contact you regarding promotional update; information; messages; and for other reasons via electronic and/or ordinary mail and, will be used by Sponsors and such promotional partners in compliance with their respective privacy practices.
SELECTION: The Selection will take place on or about November 12, 2014 and will be decided by a panel of three Earthquakes representatives. The Donation Requests will be judged based on the following areas: Overall need, amount requests based on overall funds and total number of people that will benefit from the donation. Sponsor reserves the right to not award any Donation or all Donations if, in its sole discretion, it does not receive a sufficient number of eligible or qualified Donation Requests during the Donation Request Period. The decisions of Sponsor, including the selection of youth soccer program(s) and/or elementary, middle and/or high school(s), are final and binding on all matters relating to this Donation Request.
DONATIONS: The selection(s) will reflect the total amount of money available for the Goals For Education Presented by Wells Fargo program based on the number of goals scored by the San Jose Earthquakes in 2014. For each goal the Earthquakes score during the 2014 regular season, Wells Fargo will donate $250 to the Goals For Education Presented by Wells Fargo Fund. The amount distributed to the selected youth soccer program(s) and/or elementary, middle and/or high school athletic department(s) will be based on the total amount available in the Goals for Education Presented by Wells Fargo Fund. The full amount in the Goals for Education Presented by Wells Fargo Fund will be distributed to selected youth soccer program(s) and/or elementary, middle and/or high school athletic department(s).
The Donation is non-transferable and non-assignable, with no cash redemptions or substitutions except at the Sponsor’s sole and absolute discretion. The Sponsor reserves the right to substitute a donation (or portion thereof) with one of comparable or greater value, at its sole and absolute discretion.
NOTIFICATION: The potential Selections will be notified by e-mail, mail and/or telephone (in the sole discretion of the Sponsors, as applicable) by the Sponsors or Sponsors’ agent in their sole and absolute discretion and such determination will be final and binding. In the event that any potential Selection does not respond to any such notification within five (5) days of date of issuance, a disqualification will result, Donation will be forfeited and, at the Earthquakes’ sole discretion and time permitting, an alternate potential Selection may be chosen from among all remaining eligible Donation Requests. The potential Selection may be required to submit his/her valid social security number (if applicable) and/or other identification to Sponsors and will be required to execute, have notarized and return an Affidavit of Eligibility and Release of Liability and, unless prohibited by law, Release of Publicity, within five (5) days of date of issuance. If all required documents are not properly executed and returned within the specified period of time, a disqualification will result, prize will be forfeited and, at Sponsors’ sole discretion and time permitting, an alternate potential Winner may be randomly selected from among all remaining eligible entries. Refusal or return of such documents as non-deliverable or potential Winner’s noncompliance with these Official Rules will also result in disqualification and prize forfeiture and, at Sponsors’ sole discretion and time permitting, may cause an alternate potential Winner to be selected from among all remaining eligible entries.
WAIVER OF LIABILITY/PUBLICITY RELEASE: By participating in the Goals for Education Presented by Wells Fargo Donation Request and submitting an Donation Request, each youth soccer program or elementary, middle or high school agrees to (i) be bound by these Official Guidelines, including all selection requirements, and (ii) waive any and all claims against Sponsors and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers, representatives and advertising and promotion agencies, and any and all other companies associated with the Donation Request, and all of their respective officers, directors, employees, agents and representatives for any injury, damage or loss that may occur, directly or indirectly, in whole or in part, from the participation in the Donation Request or from the receipt or use of any Donation or any travel or activity related to the receipt or use of any Donation. Selection(s), by acceptance of Donation, grants the Sponsors and each of their respective designees the right to publicize such youth soccer program’s or elementary, middle or high school’s name, address, city and state, or district, of residence, photograph, voice and/or other likeness and Donation information in any and all media now known or hereafter devised, throughout the world, in perpetuity, without additional compensation or consideration, notification or permission, unless prohibited by law.
GENERAL CONDITIONS: Released Parties are not responsible for stolen, late, incomplete, illegible, misdirected, lost, damaged, garbled, delayed, undelivered, inaccurate, postage-due or garbled donation requests, e-mail or mail. Donation Requests generated by a script, macro or other mechanical or automated means or by any means which subvert the Donation Request process will be disqualified. Released Parties are not responsible for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Donation Request, including, without limitation, errors or difficulties which may occur in connection with the administration of the Donation Requests, the processing of Donation Requests, the announcement of the Selection(s) or in any Donation Request-related materials, or the cancellation or postponement of any Major League Soccer game, event or exhibition. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Donation Request. Released Parties are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Donation Request or downloading materials from or use of the website.
Persons who tamper with or abuse any aspect of the Donation Request or website or attempt to undermine the legitimate operation of the Donation Request by cheating, deception or other unfair playing practices, or intend to annoy, abuse, threaten or harass any other entrant or Sponsors representatives or who are in violation of these Official Guidelines, as solely determined by Sponsors, will be disqualified and all associated Donation Requests will be void. Any attempt to deliberately damage the content or operation of this Donation Request is unlawful and subject to legal action by Sponsors and/or their respective agents. Sponsors have the sole right to disqualify any entrant for violation of these Official Guidelines or any applicable laws relating to the Donation Request, and to resolve all disputes in their sole discretion. Released Parties (i) make no warranty, guaranty or representation of any kind concerning any Donation(s), and (ii) disclaim any implied warranty. All disputes will be resolved under applicable U.S. laws in the County of New York, state of New York without giving effect to choice of law or conflicted law principles (whether of the state of New York, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of New York. Sponsors failure to enforce any terms of these Official Guidelines shall not constitute a waiver of that provision.
Sponsors, reserve the right, in their sole discretion, to cancel or suspend the Donation Request for any reason, including should virus, bugs, unauthorized human intervention, or other causes corrupt the administration, security, fairness, integrity or proper operation of the Donation Request. In the event of cancellation, Sponsors may elect to identify the Selection(s) and award the Donation by way of random selection from among all non-suspect, eligible Donation Requests received up to the time of such cancellation.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS DONATION REQUEST FORM IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS WILL DISQUALIFY ANY SUCH ENTRANT AND SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.
All Donation Requests must include a valid e-mail address for the entrant. Proof of providing the required information will not be considered proof of delivery to or receipt by Sponsors of completed Donation Request. In case of multiple Donation Requests received from any person or e-mail address or household, only the first Donation Request received from such person, e-mail address or household will be considered. In the event of a dispute as to the identity or eligibility of a Selection based on an e-mail address, the Selected Donation Request will be declared made by the “Authorized Account Holder” of the e-mail address submitted at the time of Donation Request provided he/she is eligible according to these Official Guidelines. The “Authorized Account Holder” is defined as the natural person to whom the applicable Internet service provider or other organization (such as a business or educational institution) has assigned the e-mail address for the domain associated with the submitted e-mail address. The potential Selection may be required to provide Sponsors with proof that he/she is the authorized account holder of the e-mail address associated with the Selected Donation Request. The Sponsors reserves the right to modify these Official Guidelines for clarification purposes without materially affecting the terms and conditions of the Donation Request Form.
SELECTION(S) LIST: For the Selection(s) names (available after November 22, 2014 mail a self-addressed stamped envelope to: San Jose Earthquakes; C/O Goals for Education Presented by Wells Fargo; 451 El Camino Real, Suite 220, San Jose, CA 95050. Selection list requests must be received by December 2, 2014.
