Quakes Foundation Membership Agreement

YOUR MEMBERSHIP WILL AUTOMATICALLY RENEW EACH MONTH OR EACH YEAR, DEPENDING ON YOUR SELECTION, UNTIL YOU CANCEL IT IN ACCORDANCE WITH THE TERMS OF THIS AGREEMENT.

  1. Introduction. The Quakes Foundation (“Foundation”) is a non-profit organization affiliated with the San Jose Earthquakes, a member club of Major League Soccer. The Foundation strives to improve the health and fitness of local youth and combat food insecurity by creating and collaborating on programs such as clinics, community events, and food programs, that generate a positive impact with an emphasis on underserved communities throughout the Greater Bay Area. The Quakes Foundation Membership Program (“Membership Program”) allows its members to support the Quakes Foundation’s mission with automatically recurring monthly or annual gifts through the Foundation’s third party partner, GiveSmart.
  1. Eligibility. To become a member of the Membership Program, you must (a) be at least 18 years of age at the time your membership begins; (b) have a valid email address; (c) create a user account with GiveSmart, accepting GiveSmart Terms and Conditions and Privacy Policy, with regards to your use of their services; (d) save a valid form of payment to your GiveSmart account for automatic, recurring donations benefiting the Foundation; (e) select your Membership level and automatic, recurring donation schedule; and (f) accept the terms of this Agreement and the MLS Privacy Policy. Upon completing the requirements, and for as long as you do not cancel your membership, you will be a “Member” of the Membership Program.

3. Benefits. You will receive certain benefits associated with the level of your donation and membership. Benefits are for your personal use, and cannot be transferred to others or used for any commercial purpose. Benefits are provided to Members as follows:

  • First Kick: $10 per month or $120 per year (Fully tax deductible)
    • Quakes Foundation membership pin
    • Thank you letter acknowledging your membership
    • Digital quarterly newsletter (email)
  • Center Circle: $25 per month or $300 per year (Fully tax deductible)
    • All First Kick benefits above
    • Discount to Foundation and San Jose Earthquakes youth camps
    • Early pre-sale access to Foundation events
    • Automatic entry to monthly sweepstakes (Prizes vary and will be announced monthly. Entry eligibility and all other terms of monthly sweepstakes are subject to the official rules of each sweepstakes.)
    • Member’s name featured on digital wall at San Jose Earthquakes home matches played at PayPal Park in San Jose, California
    • On-field recognition at San Jose Earthquakes home matches played at PayPal Park in San Jose, California
  • Legendary: $100 per month or $1,100 per year (Up to $900 tax deductible)
  • All Center Circle benefits above
  • Discounted membership rate of $100 with selection of the annual, lump sum payment schedule
  • Personalized video “shoutout” from a member of the San Jose Earthquakes team (players subject to availability)
  • Automatic entry to a “Win a Suite” sweepstakes (Date of event, and all other details to be determined by Foundation. Entry eligibility and all other terms of sweepstakes are subject to the official rules of the sweepstakes.)
  • Open training and tour at PayPal Park, including attending a San Jose Earthquakes training and an escorted tour of PayPal Park for Member and one guest (Time and date, and other details to be determined by Foundation)
  • Signed or personalized San Jose Earthquakes jersey (only after your first three (3) months of membership). Approximate fair market value of jersey is $200, and is not tax deductible. * Membership at the Legendary level requires a minimum commitment of three (3) months.

4. Auto-Renewal. By becoming a Member of the Membership Program, you acknowledge that your membership will renew every month or every year, depending on your selection, through the GiveSmart platform until you cancel in accordance with the terms of this Agreement.

  1. No Refunds; Cancellation. No refunds will be granted for any donations made to the Foundation towards the Membership Program. You can cancel your membership to the Membership Program at any time. To cancel, (a) reply to an email from the Foundation with your request to cancel; (b) call the Quakes Foundation at (408) 556-7702; or (c) send an email to communityrelations@sjearthquakes.com with the subject “CANCEL MEMBERSHIP” and include your name in the body of the email message. You will receive an email confirmation of your cancellation once it has been processed. Cancellation of your membership becomes effective at the expiration of the current month or year, depending on your section, for which you have made your final donation. For example, if you are a Legendary Member, and selected one annual payment as of July 1, 2025 and cancel your membership on February 15, 2026, your membership will expire on June 30, 2026 with no further benefits.
  1. Privacy Policy. The Membership Program and our use of your data are subject to the MLS Privacy Policy, as well as all applicable laws governing data privacy. By becoming a Member, you accept the terms of the MLS Privacy Policy.
